Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the websites, products, and services offered by Rockhammer Labs LLC ("Rockhammer Labs," "we," "us," or "our"), a Wyoming limited liability company.

By accessing or using our services, you agree to these Terms. If you do not agree, do not use our services.

Our services

Rockhammer Labs develops web-based software tools for creators, online sellers, and small businesses. Products may include digital product workflow tools, image and content automation tools, listing and seller productivity software, and related SaaS offerings.

We may add, change, or discontinue features or products at any time. Beta or preview features may be offered as-is with limited support.

Accounts and eligibility

• You must provide accurate information when creating an account or contacting us.
• You are responsible for safeguarding your credentials and for activity under your account.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to use paid services.

Subscriptions, purchases, and billing

• Paid plans and digital tool purchases are billed according to the pricing shown at checkout or in your order confirmation.
• Subscriptions renew automatically unless canceled before the renewal date. You may cancel through account settings or by contacting us.
• Fees are non-refundable except where required by law or expressly stated in a written refund policy for a specific product.
• We may change prices with reasonable notice for subscription renewals.

Acceptable use

• Do not use our services for unlawful, fraudulent, or abusive purposes.
• Do not attempt to gain unauthorized access to our systems, other accounts, or third-party services.
• Do not upload or distribute malware, spam, or content that infringes intellectual property or privacy rights.
• Do not reverse engineer, scrape, or overload our services except as permitted by law.

Intellectual property

Rockhammer Labs and its licensors own the services, software, branding, and content we provide, except for content you submit or own. These Terms do not transfer ownership to you.

You retain ownership of content you create or upload. You grant us a limited license to host, process, and display that content solely to operate and improve the services you use.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not guarantee uninterrupted or error-free operation, or that our tools will meet every business outcome you expect.

Limitation of liability

To the fullest extent permitted by law, Rockhammer Labs and its officers, members, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of our services.

Our total liability for any claim relating to the services will not exceed the greater of (a) amounts you paid us for the service in the twelve months before the claim, or (b) one hundred U.S. dollars (USD $100).

Indemnification

You agree to defend and indemnify Rockhammer Labs against claims arising from your misuse of the services, your content, or your violation of these Terms or applicable law, except where caused by our gross negligence or willful misconduct.

Governing Law

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Disputes will be brought in the state or federal courts located in Wyoming, unless applicable law requires otherwise.

Changes

We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use after changes become effective constitutes acceptance of the revised Terms.
